Terms of Service for Zyfii

Please read these Terms of Service ("Terms") carefully before using the zyfii.com website and service (the "Service") operated by Zyfii ("Zyfii," "we," "us," or "our").

Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Service, including Guests, Drivers, and Partners.

By accessing or using the Service, you agree to be bound by these Terms.

1. The Zyfii Service

Zyfii provides a technology platform that connects users (Guests) seeking transportation and tour services with independent third-party providers (Drivers) and (Partners).

You acknowledge that Zyfii is a technology platform and does not provide transportation or tour services itself. We are not a transportation carrier. All Drivers are independent contractors, not employees of Zyfii.

2. User Accounts

  • You must be at least 18 years old to create an account.
  • You are responsible for safeguarding your password and for all activities that occur under your account.
  • You must provide accurate, complete, and current information at all times. Providing false information (e.g., an invalid driver's license) will result in immediate account termination.

3. Driver-Specific Terms

Drivers are subject to the following additional terms:

  • Verification: You must submit a valid Driver's License, relevant Guide Licenses (if applicable), and a Police Report. You agree to upload a new, valid Police Report every month to maintain your active status.
  • Vehicle Condition: You warrant that your vehicle(s) are in safe, clean, and roadworthy condition at all times.
  • Subscription: Drivers receive a 1-month free trial. After this, a mandatory monthly subscription fee of Rs. 4,999 is required. This fee will be auto-billed to your saved card.
  • Commission: You agree that Zyfii will deduct a 6% commission from the fare of every completed hire.
  • Referral Commission: If you introduce a new driver, you will receive a 0.35% lifetime commission on their earnings.
  • Conduct: You must adhere to all Driver Rules, including wearing the designated "black dress" uniform.
  • Availability: Drivers who are offline for more than one (1) consecutive week will be automatically banned. A reactivation fee may apply.
  • Cash Payments: If you accept a cash payment from a Guest, you are responsible for remitting the 6% commission to Zyfii by uploading a valid bank slip for verification.

4. Partner-Specific Terms

Partners are subject to the following additional terms:

  • Subscription: Partners must pay a monthly subscription fee of Rs. 2,999.
  • Commission: Zyfii will charge a 5% commission on all hires posted by you and completed by a Zyfii Driver.
  • Payments: You must pay all subscription fees and commissions via the Payment Gateway or Bank Transfer as specified.

5. Guest-Specific Terms

  • Bookings: You must provide accurate booking details.
  • Payments: You agree to pay for all services you book.
  • Online Payment: You can pay via our payment gateway, PayHere.
  • Cash Payment: For taxi services, cash payments must be made in LKR directly to the driver. For tour packages, cash payments may be subject to different terms.
  • Custom Tours: For custom tours, a 50% advance payment is required.
  • Cancellations: Guests can cancel free of charge up to 24 hours before the pickup time. Cancellations made less than 24 hours before the scheduled pickup time may be subject to a cancellation fee as specified in the booking confirmation.

6. Fares and Pricing

  • Taxi Fares: Fares are calculated based on the formula: (Base Fare + Distance Cost + Time Cost) * 1.05, where 1.05 represents a 5% commission. Distance Cost is calculated using distance-based pricing tiers that vary by vehicle type.
  • Waiting Time: For taxi hires, the first 60 minutes of waiting time are free. After that, a fee of $3 for the next hour and $2 for every subsequent hour will be added.

7. User Content (Blogs & Reviews)

By submitting content (reviews or blogs) to the Service, you grant Zyfii a worldwide, non-exclusive, royalty-free license to use, reproduce, and display that content on our platform. You warrant that you own the rights to the content you submit. Guests who submit a blog may receive a coupon code as a reward.

8. Limitation of Liability

To the fullest extent permitted by law, Zyfii shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • (a) your access to or use of or inability to access or use the Service;
  • (b) any conduct or content of any third party on the Service (including any Driver, Guest, or Partner);
  • (c) any personal injury, death, or property damage arising from your use of the Service or any ride/tour arranged via the Service.

9. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of Sri Lanka, without regard to its conflict of law provisions.
